The Dutch mint (KNM) states that legal tender is used, so that it officially is. But, it does not guarantee that it will be accepted at all stores. Does that make it a token? At our website we sorted it as a token, but Numista would have to decide for it self.
I don't think I'd consider it a token. It is after all still a 10 Euro Cent coin. If it wasn't done by the mint, then I would simply make a note on the actual coin page that they exist.

In the Netherlands we have several type of comm. coins, the 5 euro's which can be used to pay with, although not all stores will accept it, the same with this coin. It can be used as payment, so it has to be under our countries coins, untill recently it was, I'm sure of that, I will change it back.
PS: it's always nice when someone changes things without notifying the referee.

7. Member States should not encourage mutilation of euro banknotes
or coins for artistic purposes but should tolerate it. Such mutilated
banknotes or coins should be considered as unfit for circulation.

My opinion is that it should definately be in coins section. All the commemoratives with colourful stuff on them are there and its not like you can use them in circulation..like ever.
